1. The Plaintiff is the registered holder of Exploration Licence number 08/117 to 08/118 ("Mining Tenement") and 08/636, and Mining Leases numbers 08/118 to 08/130 inclusive, which have been granted in respect of Pastoral Leases No. 3114/1027.
2. The First and Second Defendants have:
a) erected, or caused to be erected, a fence across the Plaintiff's roads on the Mining Tenement;
b) dug holes and trenches across the Plaintiff's access road from the main road to the Mining Tenement; and
c) erected, or caused to be erected in cement a sign in the middle of the access road from the main road to the Mining Tenement stating that the land is private property and that no parties may enter it.
3. By doing so, the First and Second Defendants:
a) have infringed the rights of the Plaintiff under s 66(a) of the Mining Act 1978 (WA), as the Plaintiff is severely restricted from entering and re-entering the land the subject of the Mining Tenement, for the purpose of exploring for minerals in, or under the land;
b) have infringed Section 157 of the Mining Act 1978 (WA), by obstructing or hindering the Plaintiff in the reasonable execution of its rights under the Mining Tenement; and
c) are in breach of an order of this Court made 15 January 1992.4. The Plaintiff seeks the following relief against the First and Second Defendants:
a) an order that the fences erected by the First and Second Defendants across the roads on the Mining Tenement be removed, or alternatively that the fences be fitted with gates where they cross the roads, and keys (if the gates are to be locked) be provided forthwith so that the Plaintiff, its representatives, employees and agents have vehicular access to the Mining Tenement;
b) an order that the holes and trenches in the access road from the main road to the Mining Tenement be repaired, so that the Plaintiff, its representatives, employees and agents have vehicular access to the Mining Tenement;
c) an order that the sign erected in cement and obstructing the access road from the main road to the Mining Tenement be removed, or alternatively that the sign be moved so that the Plaintiff and its representatives, employees and agents have access to the Mining Tenement;
d) an injunction restraining the First Defendant and itsrepresentatives, employees and agents, and the Second Defendant and its representatives, employees and agents, from interfering with or in any way obstructing, hindering, or otherwise impeding the Plaintiff and its representatives, employees and agents from entering upon or gaining access to any part of Pastoral Lease No. 3114/1027 which is the subject of Exploration Licences 08/118 and 08/636, and Mining Leases 08/118 to 08/130 inclusive, for the purpose of exercising its lawful rights;
e) damages for unlawfully hindering, obstructing and impeding the Plaintiff, its representatives, employees and agents from exercising the rights to explore and conduct mining operations conferred by the Mining Tenement;
f) orders for contempt of court for the willful and deliberate breach of the Warden's Court orders made on 15 January 1992; and
g) costs.
